According to London's Daily Telegarph who quotes from the studio's court papers, "This is clearly a reference to the film and fictional character Harry Potter." Everyone who sees the condoms automatically thinks of Harry Potter."

The condom brand was launched in 2006 and the name registered with the Swiss Federal Institute of Intellectual Property. A ruling is expected in a few weeks on whether to ban the name.
